AGREEMENT TERMS:
ENTIRE AGREEMENT: This agreement contains the entire understanding between Love is Red Photography and Client. It supersedes all prior agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, it does not mean that any other provision is also waived.
IMAGE DELIVERY: Client will receive a password protected gallery of all edited images. The gallery will allow users to download as many images as they would like.
CANCELLATION/POSTPONEMENT: Client understands that by entering into this agreement, Love is Red Photography is foregoing other photographic jobs. In the event of a cancellation or postponement of the event session/agreement by Client, the deposits paid are non-refundable. Deposits are transferable if a date change is necessary. Forty-eight hours notice of postponements or cancellations is appreciated.
WEATHER: If it is not possible for a session to take place on a scheduled day due to weather, Love is Red Photography and Client will reschedule on an agreed date at the earliest date possible, with no additional charge.
COOPERATION/NO SHOWS: Love is Red Photography is not responsible if Client and/or key individuals fail to appear or cooperate during the contracted time of the event or session. Love is Red Photography will not be held responsible for missed images due to details not revealed to Love is Red Photography or due to the Client not securing an individual to direct Love is Red Photography to specific photos.
COPYRIGHT: All images are copyrighted to and remain the property of the Love is Red Photography. A copyright release form will be given to the client upon request.
CLIENT’S USAGE: All non-omitted images will be edited and delivered to the Client’s gallery. The Client may print for commercial and business use only, and shall not sell any prints or authorize any reproductions by parties other than Love is Red Photography. Prints for publication (such as editorial, public relations or advertising use) require prior written consent from Love is Red Photography. A credit line which reads “Love is Red Photography” in type no smaller than that of the related text must appear adjacent to or within all permitted published photographs.
SOCIAL MEDIA: The Client may wish to publish photographs on social media outlets such as, but not limited to; Facebook, Instagram, Twitter, Snapchat, etc. In the event this occurs the Client is kindly asked to mention and tag Love is Red Photography as a photo credit. The Client MAY NOT make any edits or use any filters upon posting. The image(s) posted must be the originals provided to the Client by Love is Red Photography. The Client also understands and grants permission for Love is Red Photography to display or post images not only to the Love is Red Photography website but also any social media outlet that Love is Red Photography chooses to post to. If the Client wishes that Love is Red Photography not tag, link or mention the Client or subjects within the Client’s event photos, the Client will need to inform Love is Red Photography via letter or email.
MODEL RELEASE: Client grants Love is Red Photography the irrevocable and unrestricted right to use and publish photographs of the Client, and its attendees for in which Client may be included for editorial, trade, advertising and other purposes, and in any other manner and medium; to alter the same without restriction; and to copyright the same. Client hereby releases Love is Red Photography and her legal representatives and assigns from all claims and liability relating to said photographs.
EXHIBITION: Client grants Love is Red Photography permission to display selected images resulting from this assignment as an example of Love is Red Photography’s work and for entrance into photographic competitions and releases all claims to profits that may arise from the use of images.
LIMIT OF LIABILITY: We take the utmost care with respect to the exposure, retouching, and transportation of digital captures, proofs and prints. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Love is Red Photography’s control, Love is Red Photography’s liability is limited to the refund of all payments received, or a reshoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total number of images captured, based on the percentage of originals lost or damaged. In the event that the venue does not have suitable lighting and distorts the images captured, Love is Red Photography will not be held liable. In the unlikely event that Micah McCoy is injured, becomes too ill to attend the event, or must move outside of 100 mile radius of Florence, SC,, Love is Red Photography will make every effort to reschedule to the earliest possible date. If the situation should occur, and the event session must take place on the scheduled date, Love is Red Photography will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for that event.
CHANGES TO THIS AGREEMENT: There may be additional charges if changes are made to this agreement. The Client may increase the period of Love is Red Photography’s service on the event date, provided Love is Red Photography is available during the time requested. Added expenses resulting from such changes, including additional service cost, fees will be added on to the final balance and will be paid in full by Client prior to the departure of Love is Red Photography. The Client may not decrease the period of Love is Red Photography’s service on the event date. However, If the period of Love is Red Photography’s service is cut short by reason of fire, casualty, death, act of God or other cause beyond the control of the parties, the Client will only be responsible for the time that was captured.
RETOUCHING, CONVERSIONS AND DIGITAL FILES: By contracting Love is Red Photography the Client is granting full artistic creativity to the Love is Red Photography. All images delivered to the Client will be edited to the design that Love is Red Photography sees best fit. Retouching blemishes will be done lightly and handled with care. The Client understands and agrees that the Love is Red Photography will only touch up light or small blemishes. The Client also understands that Love is Red Photography will not include every image taken from the event, but will use professional discernment to ensure the Client receives the appropriate imagery. Love is Red Photography reserves the right to exclude images that do not fit his model or represent his business. This includes, but is not limited to blurry or out of focus images, peoples eyes closed, people in odd positions, etc.
PRICING:
Pricing is based from Love is Red Photography’s web site and is as follows
$100 per hour with a 4 hour minimum
Additional $50 per hour after 7:00pm
Events may only be booked in increments of an hour
Travel fees are $1.00 per mile after an origination of 20 miles: This is calculated by utilizing good maps and using Florence, SC as a general starting place and directing directly to the event location.
AMENDMENT: Pricing for The Client will no longer be raised on future contracts. This is the final price increase.
